Algeria is a member of the International Convention and of the PCT.

 

HOW TO REGISTER A PATENT

The requirements for filing a non-PCT application in Algeria are as follows:

(a) Name, address and nationality of the applicant;

(b) Power of Attorney in French (simply signed);

(c) Specification, claims, drawings, and abstract in French and Arabic;

(d) Assignment of Invention, if the applicant is not the inventor; and

(e) Certified copy of priority document, if applicable.

The minimum requirements for obtaining a filing date are: name, address, and nationality of the applicant; title in French; specification, claims, drawings, and abstract in English and either French or Arabic; and details of the priority application, if applicable (number, country, and filing date). All other documents can be filed within a term of two months except for the certified copy of priority document which can be lodged within a term of three months.

The requirements for filing a PCT application in Algeria are as follows:

(i) Name, address and nationality of the applicant;

(ii) Power of Attorney in French (simply signed);

(iii) Copy of the specification, claims, drawings, and abstract as published by WIPO;

(iv) Specification, claims, drawings, and abstract in Arabic;

(v) Copy of International Search Report together with Arabic or French translation thereof;

(vi) Copy of International Preliminary Examination Report; and

(vii) Copy of any changes recorded before WIPO during the International phase.

The minimum requirements for entering the National phase are: name, address, and nationality of the applicant; title in French; and a copy of the specification, claims, drawings, and abstract as published by WIPO. All other documents can be filed within a term of two months.

We estimate that the cost of filing a patent application in Algeria will be between about US$ 2300.00 and US$ 2500.00 (including the first year annuity). To this must be added costs for claiming each priority date at about US$ 130.00 per priority claim, additional publication charges of about US$ 70.00 for every five pages over the first ten, and additional publication charges of about US$ 40.00 for every page of drawing over the first three.

In the case of a PCT National phase filing, outstanding annuities are normally payable upon entering the National phase (due retrospectively on the first anniversary of the International Filing date and annually thereafter) at a cost of about US$ 450.00 per annuity.

Furthermore, should we be instructed to prepare the necessary translations, our charges for translating from English into French are about US$ 30.00 per 100 words, and about US$ 40.00 per 200 words for translating from English into Arabic.

 

HOW TO REGISTER A TRADEMARK

1.     Filing requirements

1.1 Full name, street address and description of the applicant (including trading style, if any, and state/country of incorporation, if incorporated);

1.2 List of goods and/or services;

1.3 Clear print of device mark; 

1.4 A simply signed power of attorney;

1.5 If priority is claimed: a certified copy of home application/registration.

2.     Classification

2.1 The 45 classes of the International Classification (Nice Agreement) are followed.

2.2 Multiclass - Yes.

3.     General

3.1 Duration: 10 years from date of application, renewable for further periods of 10 years (even if priority is claimed, the date is still calculated from application date).

3.2 Use: Non-use for 1 year following registration makes the registration vulnerable to cancellation.

3.3 Marking: Not required.

3.4 Licenses: Must be recorded.

3.5 Assignments: Assignment of pending applications are not permitted .

3.6 Searches available within approximately 5-10 weeks from instruction (not recommended).

4.     Costs USD

4.1a  Application: first trade mark/class $1350.00, additional classes filed simultaneously $195.00 each.

4.1b  Additional applications filed simultaneously $1220.00 per mark.

4.1c  Claiming priority: $95.00.

4.2    Assignment: First trade mark $690.00, additional trade marks filed simultaneously $190.00 each.

4.3    Change of name or address: First trade mark $400.00, additional trade marks filed simultaneously $1000.00 each.

4.4a  Renewal: First class $1010.00, additional classes renewed simultaneously $180.00 each.

4.4b  Additional marks renewed simultaneously $880.00 each.

4.4c  Renewal: Late renewal fine (possible within 6 months from expiration date): $170.00.

4.5    Searches: 1st class - From $430.00; additional classes $215.00 each.
         Searches: Each additional mark $330.00.

**Please note that the application fee covers the filing costs and normal prosecution of the application only. Additional costs could well arise upon examination of the application which are difficult to estimate as it would depend on the various requirements raised by the Registrar i.e. disclaimers, admissions etc.

 

HOW TO OBTAIN DESIGN PROTECTION

Design protection is obtainable via a national filing. Algeria is a member of the International Convention.

The requirements for filing an application in Algeria are as follows:

(a) Power of Attorney - no legalisation or notarisation necessary;
(b) 7 sets of formal drawings; and
(c) Certified copy of priority document (if priority is claimed) together with a French translation thereof.

Please note that the documents listed under item (b) are required on the day of filing.

Items (a) and (c) can be lodged up to 2 months after filing.

Multiple design applications are available in Algeria.

Our cost estimate for filing a design application in Algeria is between about US$ 1800.00 and US$ 2000.00. To this must be added further costs of about US$ 50.00 per design, about US$ 90.00 for each figure filed and about US$ 60.00 for each priority claim.

The initial period of protection is 1 year from filing. It is standard procedure to apply for a 9 year extension upon filing at an additional cost of about US$ 300.00 per design.

Should it be required, we can assist with the preparation of any translation from English to French at a cost of US$ 30.00 per 100 words.
